Terms of Service

1. Agreement
By accessing or using CeartFleet, you agree to be bound by these Terms of Service. CeartFleet is operated by BoannTech, a sole trader business based in Dundalk, Co. Louth, Ireland ("BoannTech", "we", "us").
If you do not agree to these terms, do not use the service. If you are accepting on behalf of a company, you represent that you have authority to bind that company.
2. The service
CeartFleet is a digital platform for Irish commercial vehicle operators to conduct and record RSA-required daily walk-around checks. It replaces paper-based checklists with a digital audit trail.
Compliance remains your responsibility. CeartFleet is a tool to assist with compliance; it does not guarantee compliance with RSA regulations or any other legal requirements. You remain solely responsible for ensuring your operations meet all applicable laws.
3. Accounts
Each company requires one account. You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Notify us immediately at sean.lynch@boanntech.com if you become aware of any unauthorised use of your account.
4. Subscription and billing
CeartFleet is offered on a subscription basis. Subscription plans and pricing are described on the pricing page. All payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period unless cancelled.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until then. We do not provide refunds for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
5. Acceptable use
You agree not to:
- Submit false, fraudulent, or misleading check data.
- Attempt to circumvent, disable, or interfere with the platform's security features.
- Use the platform for any unlawful purpose or in violation of any applicable regulations.
- Attempt to access data belonging to other companies or users.
BoannTech reserves the right to suspend or terminate accounts that breach these terms, with or without prior notice.
6. Data and privacy
Your use of CeartFleet is subject to our Privacy Policy, which is incorporated into these terms by reference.
You retain ownership of your company's check data and defect records. BoannTech processes this data to provide the service. On cancellation, you may request an export of your data within 90 days of your subscription ending.
7. Availability and liability
We aim to provide a reliable service but do not guarantee uninterrupted availability. There is no formal SLA at this stage of the product.
To the maximum extent permitted by Irish law, BoannTech's total liability to you for any claims arising under or in connection with these terms is limited to the fees you have paid to BoannTech in the 12 months preceding the claim.
BoannTech is not liable for any RSA fines, penalty points, vehicle prohibitions, or other regulatory consequences arising from your use or non-use of CeartFleet.
8. Changes to these terms
We may update these Terms of Service from time to time. We will provide at least 30 days' notice of material changes by email to the account holder. Continued use of the service after the effective date of changes constitutes acceptance of the updated terms.
9. Governing law
These terms are governed by the laws of the Republic of Ireland. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Irish courts.
